Governing Law & Venue

Arbitration Agreement

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms & Conditions, your use of our products, or your purchase shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

• Arbitration shall be conducted on an individual basis only; class actions and consolidated claims are strictly prohibited.

• The arbitration shall take place in Miami-Dade County, Florida, unless otherwise agreed.

• Judgment on the arbitration award may be entered in any court of competent jurisdiction.

 

Waiver of Jury Trial

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND APROCHE LLC HEREBY WAIVE ANY RIGHT TO A JURY TRIAL in any legal proceeding arising out of or relating to these Terms & Conditions, our products, or your purchase.

 

Class Action Waiver

You agree that any claim or dispute shall be brought solely on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative action.

 

Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
